Vienna, October 2022 | Dieter Heine of VHM Vavrovsky Heine Marth obtains global impact on international passenger air traffic through ECJ ruling. With the judgment published on 20 October 2022, the ECJ recognized the equality of physical and purely psychological impairments under the Montreal Convention, provided that the passenger proves an impairment of his psychological integrity which is of such severity or intensity that it affects his general state of health and cannot subside without medical treatment. The plaintiff, who ultimately took the case all the way to the ECJ to successfully enforce its claim for damages for psychological impairment suffered as a result of an emergency evacuation, was represented from the beginning by Dieter Heine and his team, both in front of the Austrian courts and the European Court of Justice.”
